1. Services Provided
Procraft Marketing offers advertising services, sales management software, and follow-up services to help Service Professionals generate more qualified appointments and convert them into paying customers.
2. Payment Terms
2.1 Our service operates on a subscription basis, and payments are made monthly in advance.
2.2 The subscription fee, as specified will be automatically charged to your chosen payment method on a monthly basis.
2.3 Additional charges for one-off setups, new campaigns, new funnels, or additional automations will be quoted and billed separately. (if needed)
2.4 Payment for the additional charges is due upon receipt of the invoice.
a. Direct Invoice: You will receive a detailed invoice specifying the nature of the additional services rendered and the
corresponding charges. Payment can be made via bank transfer or any other method specified in the invoice.
b. Online Payment: For your convenience, we offer secure online payment gateways where you can make payment for the additional charges using your preferred payment method.
2.6 Failure to make payment for additional charges within the specified timeframe may result in delays in the provision of the requested services.
2.7 All prices quoted for the additional services are in the currency specified in the invoice and are exclusive of any applicable taxes.
3. Cancellation and Termination
3.1 You have the option to cancel your services at any time. To initiate the cancellation process, you must provide us with a written notice of termination at least one week in advance of the desired cancellation date.
3.2 Upon receipt of the termination notice, your account will be scheduled for deactivation at the end of the one-week notice period.
3.3 A one-week notice period is required for service termination. If a termination notice is received during the ongoing month, the client will be billed one final payment to conclude the termination period.
3.4 Once the termination period is completed, your account will be deactivated, along with all associated assets and data.
4. Confidentiality
4.1 Your privacy is essential to us. Any information exchanged during the engagement will be treated with the utmost confidentiality.
4.2 We will not disclose or grant access to your information, including your sales pipeline, to any third parties outside of our team without your prior written consent.
5. Client Responsibilities
5.1 Appointment and Pipeline Updates:
The client acknowledges and agrees to promptly update appointment and pipeline statuses. This involves updating the status of appointments immediately following their occurrence and accurately reflecting progress in the pipeline. This includes marking stages of progress, indicating wins or losses, and updating movement between opportunity stages. Timely collaboration in maintaining an up-to-date pipeline is crucial for Procrafts lead progression process.
5.2 Funding Allocation:
As part of their responsibility, the client ensures the allocation of sufficient funds for advertising purposes. It is imperative to keep these funds up-to-date to allow for seamless advertising flow without any restriction. This proactive approach by the client contributes to the effectiveness of the advertising services provided by Procraft.
6. Client Acknowledgement
By entering into this agreement, the client acknowledges the following:
6.1 Collaborative Effort for Outcome:
The client understands that achieving desired outcomes, such as successful sales and acquiring customers, is a collaborative effort. Both parties, Procraft and the client, contribute to this process.
6.2 Framework and Expertise Provision:
Procraft commits to providing a systematic framework and leveraging its expertise to assist the client in generating leads. This framework is designed to streamline processes and allocate more time for automated tasks.
6.3 No Guarantee of Perfect Customers:
The client acknowledges that while the provided system and framework enhance the likelihood of success, Procraft does not guarantee the acquisition of perfect customers in every instance.
6.4 Commitment to Refining the Process:
The client is committed to actively working with Procraft to refine and optimise the processes. This collaborative effort aims to improve the quality of prospects generated over time.
6.5 Understanding of the Service:
The client comprehends that the service provided by Procraft is a means to an end, and success in acquiring customers depends on joint efforts and continuous refinement.
7. Governing Law and Jurisdiction
7.1 This Agreement is governed by and construed in accordance with the laws of New Zealand.
7.2 Any disputes arising out of or in connection with this Agreement shall be subject to the non-exclusive jurisdiction of the courts of New Zealand.
8. Amendments
8.1 We may update or modify these terms of engagement from time to time. Any changes will be effective immediately upon posting on our website or platform.
8.2 By continuing to use our services after any modifications, you agree to be bound by the revised terms.
9. Entire Agreement
This Agreement constitutes the entire understanding between Procraft Marketing Limited and its clients with respect to the engagement and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
10. Payment as Confirmation:
10.1 Acceptance of Terms:
By initiating and maintaining a paid subscription with Procraft Marketing, the client expressly acknowledges and agrees to the terms and conditions outlined in this engagement.
10.2 Payment as Confirmation:
Payment for the subscribed services is considered an act of confirmation of agreement to these terms. The client understands that by making payments, they are actively accepting and abiding by the terms of engagement for the provided services.
